Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the websites, games, applications and related services (together, the “Services”) operated by KimGoc Company Limited (“KimGoc”, “we”, “us”), a company registered in Hong Kong SAR.

By downloading, installing or using any of the Services you agree to these Terms. If you do not agree, please do not use the Services.

1. Eligibility

You must be old enough to form a binding contract in your jurisdiction to use the Services. Where a title carries an age rating on the App Store or Google Play, that rating applies. If you are a minor, you may only use the Services with the consent and supervision of a parent or legal guardian.

2. Licence

Subject to these Terms, KimGoc grants you a personal, non-exclusive, non-transferable, revocable licence to use the Services for your own non-commercial entertainment.

You may not:

  • copy, modify, decompile, reverse engineer or create derivative works from the Services, except where such restriction is prohibited by applicable law;
  • use cheats, automation software, modified clients or exploits that affect gameplay for other players;
  • resell, rent, sublicense or commercially exploit any part of the Services;
  • use the Services in any way that is unlawful, abusive, or that infringes the rights of others.

3. Accounts and player data

Some titles allow you to create an account or connect a third-party account (for example, Google Play Games or Apple Game Center). You are responsible for keeping your credentials secure and for activity that occurs under your account. We may suspend or terminate access where we reasonably believe these Terms have been breached.

4. Purchases and virtual items

Certain Services offer in-app purchases and virtual items. Virtual items are licensed, not sold, have no monetary value outside the relevant game, and cannot be exchanged for cash.

All purchases are processed by the App Store or Google Play. Refunds are handled under the policy of the store where the purchase was made. Where a refund obligation arises under applicable consumer law, that law prevails over this section.

5. Advertising and third-party services

Our free-to-play titles may display advertising and use third-party services for analytics, crash reporting and store functionality. Those providers process data under their own terms and privacy policies. See our Privacy Policy for details.

6. Intellectual property

All Services, including code, artwork, audio, characters and trademarks, are owned by KimGoc or its licensors and are protected by intellectual property laws. No rights are granted other than the licence expressly set out in section 2.

7. Availability and changes

We may add, change, suspend or discontinue any part of the Services, including individual titles or online features, at any time. We will give reasonable notice of a service shutdown where practicable.

8. Disclaimers

To the maximum extent permitted by law, the Services are provided “as is” and “as available” without warranties of any kind, whether express or implied, including fitness for a particular purpose and uninterrupted or error-free operation.

9. Limitation of liability

To the maximum extent permitted by law, KimGoc is not liable for indirect, incidental, special, consequential or punitive damages, or for loss of profits, data or goodwill arising from your use of the Services. Nothing in these Terms limits liability that cannot be limited under applicable law.

10. Governing law

These Terms are governed by the laws of the Hong Kong Special Administrative Region. Disputes are subject to the exclusive jurisdiction of the courts of Hong Kong SAR, without affecting any mandatory consumer protections available to you in your country of residence.

11. Changes to these Terms

We may update these Terms from time to time. The revision date at the top of this page always reflects the current version. Continued use of the Services after an update constitutes acceptance of the revised Terms.
